Terms and Conditions for Recharging of SmarTone Stored-Value SIM Card through the Internet

Recharging of Stored-Value SIM Cards through the Internet service ('Service') are made available to Customers by SmarTone Mobile Communications Limited ('SmarTone') subject to the terms and conditions of SmarTone's Sales and Services Agreement (a copy of which is available on request) and upon the following terms and conditions.

1. Use of the Service constitutes acceptance by the Customer of SmarTone's Sales & Services Agreement and the terms and conditions contained herein.
2. Information stored in the first phone book position of the Stored-Value SIM Card ('SIM Card') is for reference only. In the event of any dispute relating to such information, the books and records of SmarTone shall be conclusive evidence of the details of such information.
3. All questions and disputes regarding the airtime charges, remaining credit and expiry date of the SIM Card after each recharge through the Service will be determined by SmarTone at its sole discretion. For questions and disputes on call charges, these must be submitted to SmarTone within three (3) months from the date of the call in question.
4. SmarTone does not provide refund or make any transfer of any value of the SIM Card directed to an incorrect SIM Card account during the recharge process through the Service.
5. SmarTone reserves the right to terminate or suspend the Service if in the opinion of SmarTone there has been, or is likely to be fraudulent, illegal or improper use of the Service.
6. Any disputes in connection with or arising from the use of the Service and/or SIM Card shall be determined in accordance with the laws of Hong Kong Special Administrative Region.
7. SmarTone reserves the right at anytime to vary, modify, delete any and all of the terms and conditions contained herein.

Declaration:

I agree to be bounded by the terms and conditions once this application has been accepted by SmarTone Mobile Communications Limited. SmarTone's policy and practices in relation to personal data and the Personal Data (Privacy) Ordinance is deemed incorporated into this agreement and such policy is available upon request or by writing to the Data Protection Officer at P.O. Box 31126, Causeway Bay Post Office, Hong Kong.
